Abstract Excerpts from two FBI files regarding Anthony P. Glorioso. One (-80) describes 13 defendents who, together with certain telephony company long lines repairmen, conspired to defraud the United States of gambling excise tax and the 10% excise tax on long distance telephone service. [...] defendants attempted to conceal ... the existence and scope of their widespread horserace betting and other gambling activities by concealing their long distance telephone service through the services of telephone company long lines repairmen... the defendants secured free unauthorized long distance telephone service." The other (-70) shows how the FBI used records of NY Tel to determine that the bad guys made approximately 25 interstate telephone calls daily to telephone numbers in Cleveland, OH and New Orleans, LA. |

Abstract Letter from John D. deButts, chairman of the board, AT&T, to Clarence M. Kelley, Director, FBI regarding blue box interception of FBI telephone calls. "This refers to your recent letter to me concerning the use of a blue box to monitor telephone calls in the San Francisco area. We are aware of this blue box capability which can occur under certain wiring configurations in our traffic verification trunks and less secure features are applied. The Bell System was alerted to this vulnerability sometime ago, and the security features to prevent it were disseminated. Unfortunately, due to a unique isolated situation in a particular switching office serving a portion of the San Francisco subscribers, the security safeguards built into the circuitry failed. This condition has been eliminated by a modification to ensure it is secure. We are conducting an expeditious review of the verification trunks throughout the system to ensure that they are compatible with our security recommendations which prevent unauthorized access...." |

Abstract Serials #53 and #54 of 92-HQ-3051. Serila #53 numbered page 14 discusses use of telephone company credit cards to cover the extent of their telephone operations. Serial #54 page C says "(redacted) Intelligence Division, United States Treasury Department, New Orleans, advised on August 18 1960 that he has recently received information that the (redacted) has discovered some type of instrument or device through which gamblers are able to make long distance telephone calls but circumvent the recording of these calls by the telephone company equipment. He advised that he received this information form an Internal Revenue Agent in Miami, Florida, and was under the impression that the Miami Office was familiar with the operation of this device and might have additional information regarding its operation. He advised that he is particularly interested in determining if such a device is in existence as he has been supervising an investigation of large scale gambling operations of such operators as Benjamin Lassoff and numerous others throughout the country and he had recently noticed that there has been a surprising decrease in their long distance telephone activity. He also advised that he has received information from a New Orleans gambler that the gambling circles have again been able to circumvent the telephone toll charges. (redacted) pointed out that approximately three years ago the telephone company was able to stop a number of employees from making a toll card without recording it." |

On cross examination, (redacted) admitted for the first time that he actually listened in on legitimate telephone calls being made to and from defendant (redacted) Baton Rouge, Louisiana, and utilized information he heard during these telephone conversations to place bets on various race horses. After this admission was made by (redacted) Defense Attorney Guy B. Johnson again made oral motion that Government's evidence be suppressed because (redacted) illegally monitored legitimate telephone calls being made and received by one of the defendants. Abstract Testimony of Watson Roper Jr., a private investigator, former FBI agent, and a former employee of Southern Bell Telephone Company. On page 2335 Roper describes being hired by Southern Bell in 1958 to identify several employees of the telephone company who were committing toll fraud related to bookmaking. "The employees in question were repairman on the whole dial machine, a 4A machine, which does all the dialing from one city to another. They had access to the long distance operating board and one of them would go to a board where an operator was not on duty, take a position normally occupied by an operator, then proceed to place a call connecting a New Orleans party with a Chicago party without cost, or connecting a Chicago party with a Nevada party without cost, and so on." To monitor these calls Roper describes renting an apartment in which the telephone company installed a dial service assistance (DSA) board for each of four exchanges, plus verification trunks. Through this he was able to monitor any telephone line of 40,000 lines in the New Orleans area. |
